Virginia is really strict on motor vehicles. Best advise for you is to contact an inspection station, the Virginia State Police or the Department of Motor Vehicles.
Guys, from what I just read on the web, it sounds like a device that allows your car to be quiet on the road but you can make it rumble when you like go down the strip. I'd venture to say that this is going to be illegal in Virginia.
If it is a problem, make the questionable section bolt out. You know, flange the incoming exhuast, the ends of the "section", and the down stream end of the exhuast. When inspection time rolls around, undo your 6 bolts, drop the section out, and bolt in your legal section of pipe They shouldn't give you any gruff, as long as it doesn't leak.

Well in my neck of the woods....we have a inspection....But...I have the cable type and never had problems..they ask what it was for..I told them it was to open up my headers when I was at the track and as long as it met sound standards..when they were closed....They couldnt fail me!! I have been running them for 10 years now..and will probably upgrade to electric when the 428CJ goes in...

As far as I know, no one in the Virginia Chapter is a police officer, state inspector or works for DMV. So no one here would really know, your going to have to call either the State Police, DMV or an inspection station to find out.
All I'am saying is what I have faced running them in the state....You can have legal tinted windows "By Law" and a Cop will tell you there too dark..
I am Not a cop..But I have 2 Cousins that are..One a Roanoke City cop..and another one a State Trooper!! And If they pull you for being an A$$ they will bust you for anything and everything....and it up to the Judge to sort it out!! and 99.(% of the time the Judge doesnt Know the Vehicle Laws and goes by what the Officer has written on the Citation..
Now I live out in the Country...and I dont have ant problems with the law...

okie once again we have some more here say and conjecture from me, but as far as i know a mod to your pollution control system , exhaust, etc. that has no other purpose other than racing is not looked well upon. may not be exactly illegal, but not prolly gonna cause you an issue down the road. you know as well as i do that it wont be stricty used on track. first stop light you roll up to with a lil honda or something that sounds like a weed wacker you gonna hit the button rattle his eyeballs and get poped and wonder why. i dont think its a good idea unless you stricyul regulate your self but thats on you boss.

Straight from Virginia Legislature, can't get it anymore cut-and-dry
§ 46.2-1047. Muffler cutout, etc., illegal.
It shall be unlawful to sell or offer for sale any (i) muffler without interior baffle plates or other effective muffling device or (ii) gutted muffler, muffler cutout, or straight exhaust. It shall be unlawful for any person to operate on the highways in the Commonwealth a motor vehicle equipped with a gutted muffler, muffler cutout, or straight exhaust.
I think the legal language is referring to holes intentionally cut into the side of the muffler (which may also include rust holes). However, some judge probably would, and has, expanded that definition to include remote-operated variable exhaust cutouts.
From what I've heard, bolt on plate-type cutouts like Franken-Truck mentioned are OK; you actually have to get out and remove 3 wing nuts per pipe, and then you have your open headers. But the VA state troppers aren't going to like anything you can do from your cab, especially if it's so obvious like an electric cutout you can use to "tune your sound". I have heard of people getting away with cable-operated cutouts, but I guess it really depends on your inspector.
